Terms and Conditions

You are required to agree to the Terms of Use prior to use of the platform. We may modify Terms of Use at any time by posting the revised “Terms and Conditions” at: Caretutors. All changes will be effective immediately after we post them. We will notify our users via social media, email and the “Notice Board” of our user’s account. You are required to agree to the changes to the Terms of Use prior to further use of the Caretutors platform.

PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THIS SITE, DOWNLOADING, INSTALLING OR USING OUR MOBILE APPLICATION AND SERVICES OFFERED BY CARETUTORS. THIS AGREEMENT SETS FORTH THE LEGALLY BINDING TERMS AND CONDITIONS FOR YOUR USE OF THE PLATFORM AT CARETUTORS AND ALL SERVICES PROVIDED ON THE SITE.

By clicking on Accept or Agree to the Terms of Use when this option is made available to you or by using the Site in any manner, including but not limited to visiting or browsing the Site, you ("member, user, student, tutor, buyer, or seller") agree to be bound by this Agreement. This Agreement applies to all members of the Site, including without limitation members who are vendors, customers, and merchants, contributors of content, information and other materials or services on the Site.

Caretutors is a Marketplace

THE SITE OFFERS A MARKETPLACE FOR THOSE WHO ARE SEEKING TUTORS & WHO ARE LOOKING TO PROVIDE TUITIONS. THE TUITION RATINGS ARE SET BY GUARDIAN(S)/STUDENT(S). YOU UNDERSTAND AND AGREE THAT CARETUTORS HAS NO CONTROL OVER THE ACTS OR OMISSIONS OF ANY USER, AND CARETUTORS MAKES NO REPRESENTATIONS OR WARRANTIES ABOUT THE QUALITY OF THE SERVICES PROVIDED BY ANY USER. YOU UNDERSTAND AND AGREE THAT CARETUTORS IS NOT RESPONSIBLE FOR THE PERFORMANCE OR CONDUCT, WHETHER ONLINE OR OFFLINE, OF ANY USER OF THE SITE.

YOU AGREE THAT CARETUTORS IS AN ONLINE TUTOR MATCHING MARKETPLACE & THAT HELPS ITS USERS TO FIND THE VERIFIED TUTOR & TUITION. CARETUTORS WILL NOT BE RESPONSIBLE FOR ANY DISPUTES MATTERS ARISING OUT OF THE CONTEXT OF TUITION ENGAGEMENT BETWEEN THE TUTOR AND GUARDIAN/STUDENT. SO USE THIS PLATFORM AT YOUR OWN RISK.

Membership Eligibility

If you are a minor i.e. under the age of 18 years, you will not be able to register as a User of the platform and cannot transact on or use the platform. If you are above the age of 18, you can use the Site or Services only in conjunction with, and under the supervision of, your parent or guardian who has agreed to the Terms. If you are the parent or legal guardian of a child under the age of 18, you may use the Site or Services on behalf of such minor child. By using the Site or Services on behalf of a minor child, you represent and warrant that you are the parent or legal guardian of such child. If you do not qualify under these terms, do not use the Site or Services. Membership in the Services is void where prohibited by applicable law, and the right to access the Site is revoked in such jurisdictions. By using the Site and/or the Services, you represent and warrant that you have the right, authority, and capacity to enter into these Terms and to abide by all of the Terms set forth herein. You agree: (a) to provide accurate, current, and complete information about you as may be prompted by a registration form on the platform ("Registration Data"); (b) to maintain the security of your password and identification; (c) to maintain and promptly update the Registration Data and any information you provide to Caretutors, to keep it accurate, current and complete; and (e) to accept all risks of unauthorized access to information and Registration Data.

Tutors (Providing Service)

• As a Tutor, you are obligated to complete the service requested by the Service Requester (Student, Guardian etc.). If the Service Requester has chosen you as the Tutor, you are advised to contact the Service Requester prior to submitting your offer, to eliminate all the possible terms and conditions that would make you not fulfill the requested transaction. By submitting an offer you agree to be bound by the conditions of the request of service included in the request's description as long as those conditions are not in violation of this Agreement or unlawful.
• Tutors are bound to show proof or disclose their qualification details to the reasonable satisfaction of the student or guardian before entering into a tuition engagement and also if and as requested by them, later.
• Caretutors does not guarantee to secure a Tutor for a Student or ascertain any tuition fees on behalf of any tutor or student.
• All tuitions posted in our site are verified to the best of our knowledge. If the student or guardian does not disclose any information beforehand, Caretutors will not be responsible for the same.
• We encourage tutors to pay their platform charge through our online payment gateway because this system is safe & secure.
• The tutor is expected to conduct himself in a teacher/coach like manner, which is generally prevalent and acceptable in a tutor and student like relationship.

Platform Charge for Tutors

Caretutors does not charge any fee for creating a tutor account initially.

For online tutoring, Caretutors collect the full salary of the first month in advance from the guardian/student on behalf of the tutor. After the first month, the tutor receives the payment from Caretutors after deducting the platform charge.

For Shadow Tutoring, Caretutors collect 40% of the first month’s salary in advance from the guardian/student on behalf of the tutor. The remaining 60% of the first month's salary will be received by the tutor directly from the guardian/student at the end of the month. From the second month onward, the guardian/student will pay the tutor directly.

Refund Policy:

Caretutors has a refund policy in place for platform charge payments:

• If a tutor pays the platform charge in advance and loses the tuition job with a valid reason, the paid amount may be refunded based on the duration of the job and in accordance with our refund policy table.
• Discontinuation must be initiated by the guardian/student, with a specific and valid reason.
• If the discontinuation occurs due to issues related to the tutor’s performance or commitment, a refund will not be applicable.
• Tutors must notify Caretutors within 48 hours of any discontinuation to be eligible for consideration.
• Our team will review the case and, if applicable, calculate the refundable amount based on the percentage outlined in the refund policy.

There are certain cases when the platform charge is revised or the refund policy is applied. Please review the following scenarios:

Case 2: Cancelled After Paying Platform Charge

If a confirmed home tutoring job is cancelled within two months of its starting date and the tutor has already paid the platform charge, the invoice will be adjusted under the following special conditions:

• If the job is cancelled before the end of the first month (i.e., the full month of classes was not completed), the tutor will be charged 27.5% of the amount they actually received from the guardian/student.

  Example:

  • Agreed monthly salary: BDT 5,000
  • Total monthly classes: 12
  • Classes completed before cancellation: 7
  • Tutor already paid: BDT 5,000 × 55% = BDT 2,750
  • Tutor Payment received for 7 classes: BDT 2,917
  • Applicable platform charge: 27.5% of BDT 2,917 = BDT 802
  • Refundable/adjustable amount: BDT 2,750 – BDT 802 = BDT 1,948

• The excess amount will be refunded based on this calculation and processed within one month. If the tutor has another ongoing tuition job, the extra amount may be adjusted with that job instead of being refunded.

• If the tuition job is cancelled after completing the full month, the invoice amount will remain unchanged and be calculated as 27.5% of the agreed monthly salary for that job.

All adjustments are subject to verification by Caretutors, and tutors must report such cancellations within 48 hours for eligibility.

Note that, Caretutors reserve the right to modify platform charges or introduce new fees at any time, with prior notice posted on the website.

Guardians/Students (Requesting Service)

You must be legally able to request the services you post on the site. You must describe your request and all terms of service requested on the posting page of the site. Your posted requests may only include text descriptions, other content relevant to the posting of that request. All posted request(s) must be posted in an appropriate category. The following things you need to accept before accepting any services from Caretutors:

• For any kind of anti-social activity (stealing, threat, damages, kidnapping, raping, child abusing, harassment or any) by your hired tutor, Caretutors will not be liable for any consequences. We verify a tutor’s profile for data authenticity but if guardians/students want, they can collect the photocopy of the last or current educational qualification document from the tutor. As long as the tutor teaches, the document will be kept by the guardian/student.
• For any behavioural problem(s) by your hired tutor, Caretutors will not be responsible in this regard.
• Continuation or discontinuation of the tuition rights are entirely reserved by your hired tutor(s) only. Thus, Caretutors have no involvement or do not have the right to do so.
• Registering as guardian/student (Tutor Requester) and posting requests on Caretutors is totally free.
• During posting a tutor request, the guardian/student should enter as many details as possible for better responses from tutor(s).
• Please note that we will live your tutor request in our job board, so that our registered tutors can apply to your tuition job. Before sending it to live, our educational consultant will verify your tutor's request over the phone.
• No tutor can guarantee good grades; therefore, the grade you achieve cannot be a reason for the student to come back at a later time and demand refunds for services.
• We are not involved in any kind of interactions that take place between the tutor(s) and student(s), and hence are not liable for any dispute or disagreement or misinterpretations or arguments arising between the guardian(s)/student(s) and the tutor(s). The guardian(s)/ student(s) and the Tutor(s) are however free to take feedback and suggestions from us to solve the issue amicably.
• Student(s) are expected to conduct themselves in a student-like manner which is generally expected and regarded as ideal student behaviour prevalent in the education stream.
• Students should take enough care and make an intuitive decision before taking up an assignment to avoid any kind of repercussions. Caretutors would not be responsible and liable for any such unforeseen and unfortunate event including but not limited to bodily injury, sexual or mental harassment of any nature, if any.
• Hiring a tutor from abroad is only available for those guardian(s)/student(s) who have local relatives in Bangladesh. Without a local relative, one will not be eligible to take our service from abroad.

Payment Process (Guardians/Students-Bangladesh)

At Caretutors, there are no charges for guardians or students to hire a tutor through our platform. However, tuition fees are applicable and must be paid to the tutor directly. Guardians/students are required to confirm the tutor’s salary based on their needs, which we will include in the job post. The agreed salary will be counted from the tutor's hiring date.

For Physical Tutoring (Home Tutoring, Group Tutoring, Package Tutoring):

• Caretutors will not be involved in any financial transactions between tutors and guardians/students.
• Both parties must independently agree on a convenient method and schedule for payment.

For Shadow Tutoring:

• A 40% advance payment is required at the time of posting the tutoring requirement. The remaining 60% must be paid directly to the tutor at the end of the month.
• If any guardian/student has made an advance payment but did not confirm a tutor, they will receive a full refund after deducting the transactional charge.
• From the second month onward, no advance payment is required; guardians/students can pay the tutor directly as per the agreement.

For Online Tutoring:

• A 100% advance payment is required after confirming the preferred tutor.
• From the second month onward, guardians/students must pay the tutor directly in advance between the 1st to 10th day of each month.

Additional Notes:

• Advance payments may also be required from guardians/students who have a history of repeatedly canceling their hiring requirements.
• In such cases, the percentage of the advance may vary depending on the specific situation.

Payment Process (Guardians/Students Living Abroad)

Guardians or students living abroad (of Bangladeshi descent) who confirm a tutor through our platform must pay the tutor’s monthly salary in advance.

Payment Process – First Month:

• The guardian/student must pay the full monthly salary in advance through a local relative in Bangladesh or by themself.
• The local relative will complete the payment to Caretutors via mobile banking, including any applicable transaction charges.
• Caretutors will then transfer the salary to the assigned tutor.

From the Second Month Onward:

• The guardian/student must pay the tutor’s salary directly in advance between the 1st to 10th day of each month.

Important Note:

Our service for abroad-based guardians/students is available only if they have a local relative in Bangladesh who can make the first month's payment on their behalf. Without a local relative, one is not eligible to use our services from abroad.

Ban Policy

Caretutors expressly mentions that a user will be banned from the platform for some specific reasons. Bans can be implemented for a short period of time or for permanently . After a thorough inquiry of a user's complaint, he or she will be banned.
As long as a user is banned, there will be no possibility of getting any tuition or tutor by using our platform. Our platform can ban both users (tutor & guardian/student) based on their activities.
If a tutor is banned from our platform, he or she will be unable to apply for any tuition jobs until the ban period has expired.
Similarly, if the student/guardian is banned, the Caretutors authorities will not approve their tutor requirements, resulting in their tutor request not being posted on our job board.

Reasons for a tutor being banned will include:

• Lack of constant cooperation with us
• Inappropriate behavior with the female student or guardian/parents
• Violate platform rules
• Misleading us with wrong information
• Doing anything harmful or unethical with the platform or the guardian/student
• Creating issues with student or guardian/parents after signing the confirmation letter

Reasons for a guardian/student being banned will include:

• Lack of constant cooperation with us
• Misbehave with tutor
• Inappropriate behaviour toward the female tutor
• Doing anything harmful or unethical with the platform or the tutor
• Creating issues with tutor after signing the confirmation letter

Provide Accurate Information

Information you provide is defined by any information you provide to us or other users in the registration, offering or posting process, in any public message area or through any email feature. You are solely responsible for your information, and we act as a passive conduit for your online distribution and publication of your information. Information you provide or any requests and services you post on the Site should not: (1) be false, inaccurate or misleading; (2) be fraudulent; (3) infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy; (4) violate any law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, discrimination or false advertising); (5) be defamatory, trade libelous, unlawfully threatening or unlawfully harassing; (6) be obscene (7) contain any viruses or other computer programming routines that may damage, detrimentally interfere with, intercept or expropriate any system, data or personal information; (8) create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers; (9) link directly or indirectly to or include descriptions of goods or services that: are prohibited under this Agreement; You may not post any request on the Site (or consummate any transaction that was initiated using our service) that could cause us to violate any applicable law, statute, ordinance or regulation. Neither you, Tutors nor Service Requesters Students) may manipulate the price (offer) of any item nor you may interfere with other user's postings or transactions. We may suspend or terminate your account if we suspect any, without limiting to, any of the above. Enable us to use the information you supply us with, so that we are not violating any rights you might have in that information, you agree to grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, and database rights (but no other rights) you have in your information, in any media now known or not currently known. We will only use your information in accordance with our Privacy Policy. Information on the Site is proprietary or is licensed to “Caretutors Technologies Ltd.” by our users or third parties. You agree that you will not use any software or other automated means to access the Site for any purpose without our express written permission.

App Permission

Caretutors App needs certain permissions to run on Android and requires access to certain systems within your device. App can save personal data for users. A common reason for storage permissions is that these data will help the user to get personalized App experience.

Privacy Policy for Location Data Collection

If anyone sign up as a tutor on this platform and confirm a tuition job by the guardian, we will ask them for information about the location to enhance their experience with Check In and Check Out features and to ensure transparency in tuition attendance, even when the app is not in use.

Data Deletion Rights

User always have the information they provide to us, including the option to update or delete their information. However, please note that lack of certain information may not allow the user to access the Platform or any of its features and facilities, in part or in full.
When any user deletes their information or account on the Platform, it will be removed from our system, but we may retain some information to comply with legal obligations or business requirements. User's personal information will be anonymized to prevent identification.

Text Messages & PUSH Notifications

We send various text messages and PUSH notifications to guardians/students & tutors for notifying them about their tutor request & tuition updates.

Breach

We may limit your activity, immediately remove your offers or request postings, issue a warning to our community of your actions, suspend or terminate your membership and refuse to provide our services to you if: (1) you breach this Agreement or the documents it incorporates by reference; (2) we are unable to verify or authenticate any information to us; (3) we believe that your actions may cause financial loss or legal liability for you, our users or us.

Privacy

We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent and we only use your information as described in the Privacy Policy. If you object to your information being transferred or used in this way please do not use our services.

Liability Limit

In no event will we, nor other parties involved in the design, development and maintenance of the site, be liable for lost profits or any special, incidental or consequential damages arising out of or in connection with our site, our services or this agreement (however arising, including negligence).

Copyright Policy

Caretutors respect copyright law and expects its users to do the same. It is Caretutors policy to terminate in appropriate circumstances the Caretutors Accounts of Members or other account holders who repeatedly infringe or are believed to be repeatedly infringing the rights of copyright holders.

General

We do not guarantee that we will meet the user's requirements. Caretutors is a technology based company; so we always cannot guarantee continuous, uninterrupted & error free services. The operation of this Site may be interfered with by numerous factors outside of our control. You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the information provided by us, including any intellectual property rights of Caretutors or any person, firm or corporation having posted information for availability through the services provided by us.

You agree that in the event your post or your information violates any provision of these terms, we will have the right to refuse to provide you or any person acting on your behalf, access to the Site and Application, terminate and/ or suspend your access if applicable in the future.
